How much does it cost?
At the Wahlquist Law Firm we work on a contingency fee basis and all consultations are free. That means we do not get paid unless we get you compensation for your injuries. Typically, the contingency fee for personal injury cases in Utah is 1/3. We also advance all the costs necessary to litigate your case. We are only paid back those expenses if we are able to get a recovery for you.
What is the statute of limitations?
The law requires that claims for personal injuries be brought within a certain amount of time after the injury. This amount of time can very, depending on the type of injury. For example, in an automobile case, the statute of limitations is typically four years. In a medical malpractice case, the time limit is usually two years. However, there are many factors to consider when determining the statute of limitations and you should not make any decisions about the statute of limitations without consulting an attorney.
What is the process?
You should meet with an attorney as soon as possible after your injury. We will then begin the process of gathering evidence and meeting with witnesses. After we have an understanding of the facts of your case and the extent of your injuries, we will negotiate with the insurance company to try and reach a fair settlement. If the insurance company is unwilling to be reasonable, we will file a lawsuit and prepare for trial. No decisions about settlement are ever made without the approval of the client.
What kind of damages can I recover?
Damages in personal injury cases can be divided into two categories; economic damages and non-economic damages. Economic damages include things like medical bills, lost wages, funeral expenses, future lost wages and future medical expenses. Non-economic damages include pain and suffering as well as loss of companionship and love. We will work closely with you to make sure we are able to recover for all the damages you may have suffered.
